Dutch players are able to breathe a sigh of relief as the Amsterdam Court of Appeal has ruled that they are not to be taxed on winnings derived from PokerStars.eu.
PokerStars player Freerk Post and his legal firm Taxwise advocaten & belasting adviseurs, took the case to court claiming that since Malta is part of the European Union (EU), winning should not be subject to taxation beyond PokerStars' registration in Malta.
The tax authority argued that since PokerStars.eu was located outside of the EU, in the Isle of Man, players should have to pay taxes on winnings.
Although the case has been heard and a ruling has been made, the tax authority was given six weeks to appeal the decision.
In related news, PokerStars has rolled out a free-to-play poker game known as “Jackpot Poker” available on iOS, Android and Facebook.
Players can take part in 3-handed "winner-takes-all" poker tournaments geared for the mobile market and casual poker players. Spin & Go tournaments include a jackpot element, which is used to determine the total prize pool once all players have ben seated.
"Mobile gamers are going to love the fast-paced poker action that they can only get on the Jackpot Poker app," said Lloyd Melnick, director of social gaming at PokerStars. "By bringing Spin & Go jackpot tournaments to mobile devices, PokerStars has captured the most exciting innovation in poker in recent years and made it available to everyone with an iOS or Android smartphone."

I always have been confused as to why casino and poker winnings within the EU are tax free. This is a lot of revenue that governments could use for many essential functions, but the law prohibits this for some reason that I can't fathom. As an individual player I like the way tax free way things are for selfish & personal...
I always have been confused as to why casino and poker winnings within the EU are tax free. This is a lot of revenue that governments could use for many essential functions, but the law prohibits this for some reason that I can't fathom. As an individual player I like the way tax free way things are for selfish & personal reasons, but as a concerned member of the public who sees the necessity and value in government services I don't get it. What is the basis for this law?

Great news for the Dutch poker players, especially the professionals who make a living playing poker, I believe can now play more relaxed, knowing that will not be taxed, according to the decision of the Dutch justice. In my country things are still a little confused there is no specific law about it, but may soon be approved...
