Poker Is Illegal in South Carolina, Says State Supreme Court
According to the South Carolina State Supreme Court, the State Law is right in prohibiting wagering on Texas Hold'Em regardless of whether the game takes place in a private home or not. The court assessed that as long as money is exchanged, the activity is illegal. This refers to a case that resulted from a raid on a private home back in 2006, when 25 people were arrested and accused of illegal gambling. Assessing that the game was organized and advertised online, the court said: "even a private home can be considered a place of gaming," adding that the skill versus luck argument has little weight in the case as money changed hands so the State Law had been broken. And while Chief Justice Jean Toal agreed with the decision, he also called on state lawmakers to revise South Carolina's 200-year-old gambling statute, calling it "hopelessly outdated."
